A Regularised (Condoned) Property Is Not Second-Rate: Green Light for Renovation

frensis, 25 April 202615 September 2026

Disclaimer: This recap is provided by Frensis.com and does not represent a final assessment or an official opinion.

Economic risks:

  • The possibility of obtaining authorisation for urban planning works.
  • Risk of conflict with any local or regional councils.

Economic benefits:

  • Launch of urban projects in compliance with the regulations.
  • Potential increase in the property value of the sites.
  • Possibility of public or private funding based on urban planning regulations.

Human interpretation:

The Council of State has clarified that the amnesty title (sanatoria) confers full urban planning legitimacy, allowing urban planning works as before. This means that the parties can proceed with their urban designs without having to face obstacles due to past restrictions. The ordinary rules of the TUE (Trattamento Umano dell’Emigrazione) have been superseded, making the procedure easier and compliant with current regulations.
